US Attorney General Jeff Sessions sent a letter to Congressional leaders in June that he will not defend the individual mandate, guaranteed issue or community rating provisions of the Affordable Care Act (Obamacare). The Justice Department’s view is the guaranteed issue and community rating provisions that prevent insurance companies from denying coverage or charging higher rates to individuals with pre-existing conditions under Obamacare are closely tied to the individual mandate.
